What is probate and do I need it?

Probate is the legal process of verifying a will and authorising an executor to manage the estate. Not every estate requires it — smaller estates may be administered through the Amanah Raya or Small Estates Distribution Unit. We can assess your situation and point you toward the appropriate path.

How long does estate administration typically take?

Timelines vary depending on the complexity of the estate, court scheduling, and whether all parties are in agreement. A straightforward probate matter may take six to twelve months. Where there are disputes or multiple assets, it can take longer. We keep you informed throughout.

What happens if there is no will?

When someone passes without a will, their estate is distributed according to the Distribution Act 1958 (for non-Muslims) or Faraid rules (for Muslims). An administrator will need to apply for Letters of Administration. We assist families in navigating this process with as little difficulty as possible.

Can disputes between family members be resolved without going to court?

In many cases, yes. We always explore negotiation and mediation first, as these approaches tend to be less costly and preserve family relationships better than contested court proceedings. Court representation is available when it becomes necessary.
